1. INTRODUCTION

1.1 These Auction Terms and Conditions govern all auction transactions conducted through the Solvera platform.

1.2 By registering as a bidder, placing a bid, consigning a watch for auction, or otherwise participating in an auction, users agree to be bound by these Auction Terms and Conditions, the Solvera Terms of Service, and the Solvera Privacy Policy.

1.3 Solvera reserves the right to amend these Auction Terms and Conditions from time to time.

2. ELIGIBILITY OF BIDDERS

2.1 Bidders must:

  • be at least eighteen (18) years of age;
  • have legal capacity to enter into binding agreements;
  • possess authority and financial ability to complete purchases.

2.2 Solvera reserves the right to request identity verification, proof of address, proof of payment source, or any additional information reasonably required for compliance or fraud prevention purposes.

2.3 Solvera may refuse registration or bidding privileges at its discretion.

2.4 Solvera may require completion of identity verification, address verification, payment card verification, or other verification procedures before granting bidding privileges.

2.5 Solvera reserves the right to suspend, restrict, or revoke bidding access where verification requirements are not met or where fraud prevention concerns arise.

3. BIDDER REGISTRATION

3.1 Bidders must create a Solvera account before participating in auctions.

3.2 Bidders are responsible for ensuring that all account information remains accurate and up to date.

3.3 Bidders are responsible for all activity conducted under their account credentials.

4. STARTING BID PRICE

4.1 Each Auction Lot shall have a Starting Bid Price determined and approved before the commencement of the auction.

4.2 The Starting Bid Price represents the opening reference price for the Auction Lot and the minimum level from which bidding may commence.

4.3 Bids must exceed the Starting Bid Price and comply with the applicable bid increment rules.

4.4 For example, where the Starting Bid Price is RM25,000 and the applicable bid increment is RM100, the first valid bid shall be RM25,100.

4.5 Once a valid bid has been placed above the Starting Bid Price and the auction concludes successfully, the Seller shall be bound to complete the sale to the successful bidder.

5. BID INCREMENTS

5.1 Unless otherwise stated, each valid bid must increase the current bid by RM100.

5.2 Solvera reserves the right to amend bid increment rules for any Auction Lot where reasonably necessary for operational, technical, or auction administration purposes.

6. COMING SOON PERIOD

6.1 Prior to publication, the Seller shall be given the opportunity to review and approve photographs, descriptions, specifications, and listing information relating to the Auction Lot.

6.2 If no feedback or objection is received within forty‑eight (48) hours of submission for approval, the listing shall be deemed approved by the Seller.

6.3 Following approval or deemed approval, the Seller may not withdraw the Auction Lot without Solvera's written consent.

6.4 Where the Seller withdraws an Auction Lot after approval or deemed approval, Solvera reserves the right to recover reasonable costs already incurred, including photography fees, marketing costs, authentication costs, shipping costs, and administrative expenses.

7. AUCTION PERIOD

7.1 Unless otherwise stated, each auction shall remain open for five (5) calendar days.

7.2 Solvera reserves the right to extend, shorten, suspend, or reschedule auctions where reasonably necessary.

7.3 Any valid bid placed within the final five (5) minutes of an auction may automatically extend the auction by an additional three (3) minutes.

8. BINDING NATURE OF BIDS

8.1 Every bid submitted constitutes a legally binding offer to purchase the Auction Lot.

8.2 Bids cannot be withdrawn once placed except where approved by Solvera in exceptional circumstances.

8.3 Bidders are responsible for ensuring that they have sufficient funds available prior to bidding.

9. SUCCESSFUL BIDDER

9.1 Subject to these Auction Terms and Conditions, the highest valid bid at the close of the auction shall be declared the successful bid.

9.2 In the event of disputes, technical issues, suspected fraud, irregular bidding activity, duplicate bids, system errors, or other circumstances affecting the integrity of the auction, Solvera reserves the right to determine the successful bidder, reject bids, reopen bidding, extend the auction, or cancel the auction where reasonably necessary.

9.3 The successful bidder shall become legally obligated to complete payment for the Auction Lot.

9.4 Solvera may reject bids that are suspected to be fraudulent, irregular, manipulative, or otherwise inconsistent with the integrity of the auction process.

10. PAYMENT AND BUYER'S PREMIUM

10.1 To participate in an auction, Solvera may place a temporary authorisation hold on the Bidder's credit card equal to ten per cent (10%) of the Starting Bid Price.

10.2 The purpose of the authorisation hold is to confirm participation in the auction and reduce non‑serious bidding activity.

10.3 The authorisation hold does not constitute payment or a charge unless the Bidder becomes the successful bidder.

10.4 If the Bidder does not become the successful bidder:

  • no purchase payment shall be required;
  • no Buyer's Premium shall be payable; and
  • the authorisation hold will be released automatically, subject to the processing time of the relevant card issuer or payment provider.

10.5 If the Bidder becomes the successful bidder, the Bidder shall pay:

  • the Winning Bid; and
  • the Buyer's Premium, being ten per cent (10%) of the Winning Bid.

10.6 The authorisation hold shall be applied as the first part of the Buyer's Premium payable by the successful bidder. Any remaining balance of the Buyer's Premium may be charged after the auction.

10.7 The Winning Bid shall be paid by online bank transfer or any other payment method approved by Solvera.

10.8 Full payment must be completed within seven (7) calendar days from the close of the auction unless otherwise stated.

10.9 Ownership of the Auction Lot shall not pass until full payment has been received and cleared.

10.10 Failure to complete payment within the stipulated period constitutes bidder default.

11. BIDDER DEFAULT

11.1 Where a successful bidder fails to complete payment:

  • the auction may be cancelled;
  • bidding privileges may be suspended;
  • accounts may be restricted or terminated;
  • authorisation holds, and buyer premiums may be forfeited;
  • the Auction Lot may be re‑auctioned.

11.2 Defaulting bidders may remain liable for losses incurred by Solvera or the Seller.

12. RE-AUCTION

12.1 Solvera reserves the right to re‑auction any Auction Lot following bidder default.

12.2 Any difference between the original successful bid and the subsequent sale price may be recoverable from the defaulting bidder.

13. SHIPPING AND COLLECTION

13.1 Before release or shipment, Solvera shall perform a final verification to ensure that the watch, box, papers, accessories, and contents of the transaction correspond with the approved listing and winning auction details.

13.2 Buyers may choose either self‑collection or shipping unless otherwise specified.

13.3 Collection shall be by appointment and only after full payment has been received and cleared.

13.4 Where the Buyer appoints a representative or third party to collect the Auction Lot on their behalf, Solvera may require written authorisation and proof of identity prior to release of the Auction Lot.

13.5 Where shipping is requested, Solvera may assist in arranging shipment through third‑party logistics providers.

13.6 Shipping insurance shall be arranged for the value of the Auction Lot during transit, where shipment is organised by Solvera.

13.7 The Buyer shall bear all shipping costs, insurance costs, customs duties, taxes, import charges, and other related charges unless otherwise agreed in writing.

13.8 Solvera shall use reasonable care in selecting reputable shipping providers but shall not be liable for delays, losses, customs issues, or failures arising from the acts or omissions of third‑party logistics providers.

13.9 Risk of loss or damage shall transfer to the Buyer upon delivery of the Auction Lot to the Buyer or the Buyer's authorised representative.

13.10 Where the Buyer appoints a specific courier, freight forwarder, collection agent, or representative, risk transfers immediately upon delivery to such party.

14. COMPLAINTS AND AFTER-SALES

14.1 Buyers shall notify Solvera of any complaint relating to the Auction Lot within seven (7) calendar days from the date of receipt of the Auction Lot.

14.2 Failure to notify Solvera within the Complaint Period shall constitute acceptance of the Auction Lot and waiver of the right to raise complaints relating to matters that could reasonably have been identified during inspection.

14.3 Complaints submitted after the expiry of the Complaint Period may not be entertained.

14.4 Buyers are strongly encouraged to inspect the parcel upon arrival and to retain photographs or videos of the package and unboxing process.

14.5 Such records may assist with shipping insurance claims, transit damage investigations, missing item investigations, or dispute resolution processes.

14.6 Questions regarding the operation, condition, or ownership experience of the watch may arise after a period of use. Solvera may, at its discretion, provide reasonable after‑sales assistance and guidance where appropriate.

14.7 Any after‑sales assistance provided by Solvera shall not constitute an extension of warranty, guarantee, or acceptance of liability unless expressly stated in writing.

15. AUTHENTICATION AND CONDITION

15.1 Prior to publication of an Auction Lot, Solvera may carry out inspections, testing, verification, authentication reviews, or other checks considered appropriate.

15.2 Such checks may include, where appropriate, but are not limited to:

  • timekeeping accuracy;
  • power reserve performance;
  • water resistance testing;
  • authenticity review; and
  • condition assessment.

15.3 Information that Solvera considers material to the purchasing decision shall be included in the listing where reasonably possible.

15.4 Condition reports, photographs, descriptions, measurements, and observations are intended to assist Buyers in making informed decisions but may not constitute exhaustive technical assessments.

15.5 Buyers acknowledge that pre‑owned watches may exhibit characteristics associated with age, wear, ownership history, servicing history, replacement components, polishing history, and previous repairs, which may not be fully visible in photographs.

15.6 Unless expressly stated otherwise in writing, Solvera does not guarantee future performance, investment value, collectability, appreciation, or resale value of any Auction Lot.

16. PROHIBITED CONDUCT

Users shall not:

  • manipulate bids;
  • create multiple accounts;
  • submit false information;
  • interfere with auctions;
  • engage in skill bidding;
  • circumvent platform fees by transacting off‑platform.

17. AUCTION CANCELLATION

Solvera reserves the right to cancel, suspend, or withdraw any auction where:

  • ownership disputes arise;
  • authenticity concerns arise;
  • technical failures occur;
  • fraud is suspected;
  • legal or regulatory concerns arise.

18. SELLER SETTLEMENT

Settlement to Sellers shall only occur after:

  • payment has cleared;
  • delivery has been completed;
  • complaint periods have expired;
  • no disputes remain outstanding;
  • no disputes, chargebacks, payment reversals, or fraud investigations remain outstanding.

19. LIMITATION OF LIABILITY

19.1 To the fullest extent permitted by law, Solvera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the platform or auction services; (ii) any conduct or content of any third party; (iii) any content obtained from the platform; or (iv) unauthorized access, use, or alteration of your transmissions or content. In no event shall Solvera's aggregate liability exceed the total Buyer's Premium paid or payable in connection with the relevant auction.

20. GOVERNING LAW

These Auction Terms and Conditions shall be governed by the laws of Malaysia and subject to the exclusive jurisdiction of the Malaysian courts.
